1. Scope of Application
These Terms and Conditions ("Terms") govern the use of the website malevolent.online and all services offered by Malevolent GmbH ("we", "us", "the Company"). By accessing the website or engaging our services, you agree to be bound by these Terms.
2. Services
Malevolent GmbH provides debt collection services, loan products, and debt purchasing. All services are subject to separate service agreements entered into individually with each client. These Terms apply in addition to such service agreements.
3. Eligibility
Our services are available to businesses and private individuals resident or registered in Germany, or holding German-law receivables. All loan applicants must be at least 18 years of age and meet applicable creditworthiness requirements under German law.
4. Fees & Interest Rates
Applicable fees and interest rates are disclosed in the respective service agreement and in accordance with the German Price Disclosure Regulation (PAngV). Collection fees are success-based unless otherwise agreed in writing. All interest rates stated are effective annual rates (effektiver Jahreszins).
5. Intellectual Property
All content on this website — including logos, text, graphics, and software — is the exclusive property of Malevolent GmbH and protected under German and European copyright law. Reproduction or distribution without prior written consent is prohibited.
6. Limitation of Liability
Malevolent GmbH shall not be liable for indirect, incidental, or consequential losses arising from the use of this website or our services, except in cases of intentional misconduct or gross negligence. Liability for guaranteed characteristics remains unaffected.
7. Governing Law & Jurisdiction
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for disputes with merchants (Kaufleute) is Frankfurt am Main, Germany.
8. Changes to These Terms
We reserve the right to update these Terms at any time. The current version is always available at malevolent.online/terms. Continued use of our services after an update constitutes acceptance of the revised Terms.
